Welcome to MekaMove (“we”, “us”, “our”). These Terms of Service (“Terms”) govern your access to and use of our websites, apps, and services (the “Services”). By creating an account or using the Services, you agree to these Terms.

Eligibility & Accounts

  • You must be at least the age of majority in your jurisdiction and capable of entering a contract.
  • Provide accurate information and keep your account secure; you’re responsible for all activity under it.
  • We may verify identity and request additional documentation where required by law or for safety.

Platform Role

MekaMove connects guests with independent guides/drivers to schedule trips. We are not a transportation carrier. Except where expressly stated, guides provide services as independent contractors, not as our employees or agents.

Bookings & Payments

  • When you confirm a booking, you agree to the shown fare and applicable fees/taxes.
  • Charges may include base fare, tolls, waiting time, adjustments (e.g., route changes), and service fees.
  • Receipts/invoices will be issued electronically to your registered email or in-app.
  • Fraud checks may delay or block transactions for safety and compliance.

Cancellations & Refunds

  • Cancellation windows and fees are shown at booking time and in our Help Center.
  • No-show or late cancellations may incur fees to compensate guides for time and travel.
  • Refund eligibility depends on ride status, timing, and policy exceptions (e.g., safety incidents).

Guide Obligations

  • Hold and maintain all required licenses, insurance, and vehicle standards.
  • Arrive on time, follow local laws, and provide a safe, professional experience.
  • No discrimination, harassment, impaired driving, or unsafe conduct.
  • Comply with our rating and review standards; repeated low ratings may affect access to the platform.

Guest Obligations

  • Be ready at pickup, respect waiting time rules, and follow local laws (e.g., seat belts, child seats).
  • Provide accurate locations and special requirements in advance (e.g., luggage, accessibility).
  • No abusive conduct or property damage; cleaning or repair fees may apply.

Safety & Conduct

We prioritize safety through verification, in-app tools, and support. If you observe unsafe behavior, contact emergency services first and notify us via the app. We may suspend or remove accounts for policy violations or safety risks.

Fees, Taxes, Receipts

  • We may charge service fees to support operations and improvements.
  • Taxes are calculated based on local requirements; you are responsible for any applicable taxes.
  • Receipts summarize fare, fees, discounts, and taxes for each completed trip.

User Content & Reviews

  • Reviews must be honest, relevant, and free of hate speech, harassment, or personal data of others.
  • We may moderate, hide, or remove content that breaches these Terms or the law.
  • You grant us a non-exclusive, worldwide license to host and display content you submit to the Services.

Intellectual Property & License

We retain all rights in the Services and brand assets. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the Services for their intended purpose.

Third-Party Services

The Services may integrate mapping, payments, analytics, or other third-party tools. Their terms and privacy policies apply to your use of those features.

Warranty Disclaimer

The Services are provided “as is” and “as available.” We disclaim all warranties to the fullest extent permitted by law, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data. Our aggregate liability arising out of or in connection with the Services shall not exceed the greater of (a) amounts paid by you in the three (3) months prior to the event giving rise to the claim, or (b) USD $100.

Indemnification

You agree to defend, indemnify, and hold harmless MekaMove, its affiliates, and personnel from claims and expenses (including reasonable legal fees) arising from your use of the Services or violation of these Terms.

Termination & Suspension

We may suspend or terminate access at any time for violations, safety concerns, fraud, or legal compliance. You may stop using the Services at any time. Certain rights and obligations survive termination.

Governing Law & Dispute Resolution

These Terms are governed by the laws of your primary contracting entity’s jurisdiction (to be specified by MekaMove). Disputes will be resolved through good-faith negotiations; if unresolved, they may be submitted to binding arbitration or courts with appropriate jurisdiction, as applicable by local law.

Changes to Terms

We may update these Terms from time to time. Material changes will be notified in-app or via email. Your continued use after changes become effective constitutes acceptance of the revised Terms.
